Since 1991 Korean migrant worker market is ruled by the so-called Industrial Trainee System (ITS), but it has nothing to do with any kind of traineeship but hard and long time works. In fact it is the modern form of slavery. Migrant workers there even don't have human rights. Many were forced to work nearly everyday without any holiday. Which migrant workers are not recognize as an workers but other hand they got lowest wage. And of course migrant workers got only dirty, difficult and dangerous jobs- so called 3d jobs. This conditions forces the trainees to search for jobs with better conditions.
They have nothing to be an illegal migrants. Because the visa for Korea is connected only for the company where he worked. On the other hand some of migrant come here by 10,000$ give it to brokers by tourist visa and then they become an illegal workers.
So ITS is making the illegal staying.
All we know that in Korea migrant workers have only two system. One is so called legal which are under ITS and others are illegal and about 80% of 400,000 migrant workers are illegally working here. That means there have no any working visa system even though all are working here.
This year the Korean govt. are going to present the EPS (Employment Permit System) for new comer migrant workers. In our analysis the EPS is similar form of ITS. What could never reduce the illegal staying. Because in EPS bill one of articles have the migrant should be recognize as an worker by the labor 3rights. But they don't have right to change the working factory and after one year if they pass the examination from employer then they could get extension for another year and after 3 years they have to go back. This bill is only profitable for employer where have no chance to establish the labor rights. For an example if workers unionized or demand the increase his salary then he could never appropriate for extension another year, or if he don't like to work same factory then he must be an illegal as like now. And when he finished the fixed 3 years he must run away from his factory and became an illegal. So we can say it that EPS never help to decrease the illegality.
In EPS bill there have another article that they don't have rights to bring, there wife or family also have no free housing or living place from factories. If they are workers they have rights to live with there family. And if they sleep another place then who will the responsible if they got any accident?
The applicants could apply to govt. of home country and Korean govt. should make the quota as they need according to the bill of EPS. In that case different countries govt. must make the brokers problems as like now. Our opinion is workers should have apply to ambassador of Korea and then come to Korea like USA , Canada, Europe or Australia immigrant processing system.
Our clear demand is WPS (Work Permit System) which is proper system for a migrant worker what could be the guarantee to keep labor rights and human rights and which must decrease the illegality and which keep the law of ILO. 5 years working visa system for new comer is our demand.
The EPS is for new comer even though its are modified form of ITS. Then how about now staying undocumented migrant workers? The 80% of migrants are living dangerous conditions because Korean govt. any time hunt them and deport them their home countries. If EPS don't concern about them then our struggle will be continue until achieve the legality of all migrant workers.
Our (ETU-MB with KCTU) clear demand is legalize and the whole migrant workers who are nothing but works and give us 5 years working visa what is keep all human rights according to ILO.
We oppose the EPS- EPS is only a modified of ITS.
이주노동자들은 하나로 변형된 연수생제를 원하지 않는다.
1991년부터 한국의 이주노동자 시장은 소위 산업연수생제(ITS)로 불리는 제도로 굴러왔지만, 이 제도는 연수생으로서의 일체의 소속감도 가져다주지 못한 채 힘들고 오랜 시간의 노동을 가져다줄 뿐이었다. 사실 그것은 현대판 노예제도나 다름없다. 이주노동자들에게 인권은 없다. 많은 이들이 거의 매일 휴일 없이 일에 매진하고 있다. 어떤 이주노동자들은 노동자로서가 아니라 가장 낮은 임금을 받는 다른 종류의 일손으로 밖에 인식되지 않는다. 그러다 보니 당연히 이주노동자들은 소위 3D 업종이라 불리는 더럽고, 어렵고, 위험한 일을 하게된다. 이러한 상황 때문에 연수생들을 어쩔 수 없이 더 낳은 상태의 직업들을 찾아 나서게 한다. 한국 비자는 오로지 그가 일했던 회사와만 연결 되있기 때문에 그들의 이동이 불법의 형태가 되지만, 그들은 결코 불법적인 이주자가 아니다. 다른 한편의 이주노동자는 약 10,000달러를 브로커에게 주고 여행비자로 여기에 오는데, 그 과정에서 그들은 역시 불법체류노동자가 된다. 그래서 산업연수생제(ITS)는 불법체류를 만드는 것이다.
우리가 알다시피 한국에서 이주노동자들은 단지 두 가지 제도아래 놓여져 있다. 하나는 산업연수생제도 아래서 소위 합법적인 형태로 다른 하나는 불법적인 형태로 놓여져 있는 것이다. 여기에서는 전체 이주노동자 40만 명 중 80% (32만 명)가 불법적으로 일하고 있다. 그것은 비록 그들이 여기서 일하고 있어도 노동비자 제도를 가질 수 없다는 것을 의미한다.
올해 한국정부는 새로 들어오는 이주노동자를 위해 고용허가제를 시행할 예정이다. 우리의 분석으로는 고용허가제는 불법적인 상태를 결코 경감시킬 수 없는 산업연수생제도와 비슷하다. 왜냐하면 산업연수생제 조항 중에는 이주노동자를 노동3권에 의해 노동자로 인정해야만 하는 게 있지만, 그들은 일하는 사업장을 이전할 권리를 가지지도 못하고, 1년 후에 고용주로부터 시험에 통과하면 또다시 1년이 확장되고, 3년 후에는 되돌아가야만 하기 때문이다. 이 법은 단지 노동권을 보장해줄 생각이 없는 고용주에게만 유리한 것이다. 예를 들어 노동자들이 노동조합을 조직하거나 그들의 임금인상을 요구한다면 1년 확장이 이루어질 수 없고, 또 노동자들이 같은 사업장에서 일하는 것을 원하지 않는다면 그는 지금과 같이 불법적으로 일해야만 한다. 그리고 정해진 3년이 끝난 후에 그의 사업장을 이탈하려 한다면 불법적이게 된다.
고용허가제에서 그들이 제기할 권리를 가질 수 없는 또 다른 조항이 있고, 배우자나 가족들이 사업장으로부터 떨어져서 거주하거나 생활할 자유도 없다. 그들이 노동자라면, 그들은 거기서 가족들과 살 권리를 가진다. 그렇다면 다른 장소에서 자거나, 그들에게 사고가 난다면 책임질 수 있는 사람은 누구일까?
신청자는 본국의 정부에 신청해야 하고, 한국 정부는 고용허가제 법안에 따라 그들이 필요한 몫을 만들어야만 한다. 그 경우에 다른 나라 정부는 지금과 같은 중개인 프로그램을 만들어야만 한다. 우리의 의견은 노동자들이 한국의 대사관에 의뢰하여 미국, 캐나다, 유럽 혹은 호주의 이주민제도와 같은 방법으로 한국에 와야한다는 것이다.
우리의 명확한 요구는 이주노동자를 위해 노동권과 인권을 유지시켜줄 보증이 되고, 불법을 감소시키며, ILO에서 권고하는 5년 동안의 노동비자를 유지할 노동허가제이다.
산업연수생제의 변형된 형태인 고용허가제는 새로 들어오는 사람을 위한 것이다. 그렇다면 이미 밀입국된 이주노동자는 어떻게 유지할 것인가? 왜냐하면 한국 정부는 어느 때고 그들을 사용하고 그들을 본국으로 추방하기 때문에, 이주노동자의 80%는 위험한 상태에서 살고 있다. 만약 고용허가제가 그들에게 관여하지 않는다면 우리의 투쟁은 모든 이주노동자들의 합법성을 얻을 때까지 계속될 것이다.
한국의 이주노동자인 우리의 명확한 요구는 ILO의 규정에 따라 모든 인권이 유지되는 5년의 노동비자를 우리에게 주고, 법제화하는 것이다.
